Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Peter Jones Experience Design LLC (“Hona,” “we,” “us,” or “our”) governing your use of the Hona iOS app, its Apple Watch companion, the optional Hona Garmin Connect IQ data field, and related services (together, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

1. Acceptance of these Terms

By downloading, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for it.

3. The Service and beta status

Hona helps athletes and coaches track training, recovery, and nutrition, and provides readiness scores, training-load metrics, and AI-assisted insights.

The Service may currently be offered as a beta / TestFlight release. Beta versions are provided for evaluation, may be incomplete or contain errors, may change or be discontinued at any time, and may not be as reliable as a final release. Any feedback you provide may be used by us without obligation to you.

4. Accounts

You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your login credentials, and for all activity under your account. You agree to notify us promptly of any unauthorized use. You may sign in using email and password, Sign in with Apple, or Google.

5. Coach and athlete relationship

The Service lets athletes link to a coach and lets coaches view and manage data for their linked athletes.

• If you are an athlete, linking to a coach grants that coach access to the training, recovery, and activity data you share, and the ability to message you. You control whether to link and can ask to be unlinked.
• If you are a coach, you agree to use athlete data only to provide coaching to that athlete, to keep it confidential, and not to use it for any other purpose. You are responsible for your own conduct and advice.

Hona provides software tools only. We are not a party to the relationship between a coach and an athlete and are not responsible for advice, training plans, or conduct exchanged between them.

7. AI-generated content

Some features use third-party AI models (Anthropic’s Claude) to generate insights and suggestions. AI output can be inaccurate, incomplete, or inappropriate for your situation. Treat it as informational only, apply your own judgment, and do not rely on it as professional, medical, or nutritional advice. See the Privacy Policy for what data is sent to the AI provider.

8. Third-party services

The Service integrates with third-party services including Apple Health, Oura, Strava, Whoop, Google/Firebase, and the USDA FoodData Central and Open Food Facts databases. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services, and your authorization to connect them can be revoked by you at any time. Strava, Apple, Oura, Whoop, and Google are trademarks of their respective owners and do not endorse Hona.

9. Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in violation of these Terms;
• access another user’s data without authorization, or attempt to circumvent the Service’s access controls or encryption;
• reverse engineer, decompile, or attempt to extract source code or API keys from the app, except where permitted by law;
• interfere with or disrupt the Service or its infrastructure, or use it to transmit malware;
• scrape, resell, or commercially exploit the Service or its content without our permission;
• misuse another person’s health data obtained through the Service.

10. Your content

You retain ownership of the data and content you submit (workouts, logs, notes, messages). You grant us a limited license to host, process, and display that content solely to operate and provide the Service to you and, where you choose, to your linked coach. You are responsible for the content you submit and confirm you have the right to submit it.

11. Intellectual property

The Service, including its software, design, branding, and the “Hona” name and logo, is owned by us and protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial training and coaching use, subject to these Terms. We reserve all rights not expressly granted.

12. Fees and subscriptions

The Service is currently provided free of charge during beta. We may introduce paid features or subscriptions in the future. If we do, any purchases will be made through the Apple App Store and governed by Apple’s payment terms, and we will disclose pricing and renewal terms at the point of purchase before you are charged.

13. Disclaimers of warranty

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA OR METRICS WILL BE ACCURATE OR COMPLETE.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HONA AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, OR FOR ANY PERSONAL INJURY OR HEALTH CONSEQUENCE ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON ITS OUTPUTS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR USD $50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Hona and its operator from any claims, damages, or expenses (including reasonable legal fees) arising out of your use of the Service, your content, your violation of these Terms, or your violation of any law or the rights of a third party.

16. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including Sections 6, 10–11, and 13–15) will survive.

17. Governing law and disputes

These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in Maricopa County, Arizona for any disputes, except where applicable law gives you the right to bring a claim elsewhere.

18. Changes to these Terms

We may update these Terms from time to time. We will post the updated version with a new “Last updated” date and, for material changes, provide notice in the app or by email. Your continued use after changes take effect means you accept the updated Terms.

19. Apple App Store terms

If you obtained the app from the Apple App Store, you acknowledge that these Terms are between you and Hona, not Apple; that Apple has no obligation to provide support or maintenance for the app; and that Apple is a third-party beneficiary of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.
